4G Wireless, Inc. vs. Ghoreshi
Plaintiff Marquis Marine?s motion to compel further RFPD response by defendant Medhi Ghoreishi is DENIED without prejudice. First, plaintiff Marquis Marine?s motion to compel further RFPD responses by defendant Mehdi Ghoreishi is procedurally defective because there is no supporting separate statement as required. See, Rule 3.1345(a)(3). Second, plaintiff Marquis Marine has not made an evidentiary showing of ?good cause? for production the documents and items demanded. See, Digital Music News LLC v. Superior Court (2014) 226 Cal.App.4th 216, 224. Third, plaintiff Marquis Marine concedes that defendant Mehdi Ghoreishi has now served supplemental RFPD responses. This started a new 45 day period for the parties to meet and confer over defendant Medhi Ghoreishi?s supplemental responses and to seek to informally resolve any disputes over these supplemental responses. See, C.C.P. ? 2031.310(c).
Moving party to give notice.
Other Matter: The evidence reveals that plaintiff Marquis Marine has reasonably attempted to set an inspection of the vessel ?Mo Money.? While the Court?s 11/19/2015 Minute Order requires plaintiff?s counsel to arrange such an inspection with defense counsel, defendant?s refusal to provide any date or dates for such an inspection appears to be without justification.? At the hearing the parties are to be prepared to discuss a suitable inspection date and protocol.
