MODIFICATION OF OPINION

THE COURT:

The opinion in this matter, filed June 12, 2008, is modified as follows.

On page 2, first full paragraph, the second sentence is revised to
read:

?We affirmed on appeal (People v. Alcala (1992) 4 Cal.4th
742 (Alcala II)), but a federal district court set aside that
judgment, and the United States Court of Appeals for the
Ninth Circuit affirmed the federal district court?s judgment.

This modification does not effect a change in the judgment.
