THE COURT.-

The opinion appearing herein at 26 Cal. 4th 1216 is modified as follows:

The second sentence of the first full paragraph on page 1228 is modified to read as follws:

Instead, the trial court permitted the City Attorney to retain possession of the records in question, based on Halford’s promise to ensure the records would be maintained for three years.

This modification does not affect the judgment.
