Defendants and Cross-Complainants Norby Acevedo and Mercedes Villeda move for a discretionary stay of these proceedings. No legal authority is offered as the basis for the stay. Plaintiff only cites authority that an appeal from a judgment of costs need not be bonded. Rather than demonstrating good cause for a stay, the motion repeats allegations previously discussed in numerous demurrers to the cross-complaint. The motion is replete with ad hominem attacks on the motives of Plaintiff and her counsel in pursuing this litigation.

Plaintiff has appealed from this Court’s ruling on a CCP section 128.7 motion. She has also appealed from this Court’s discovery ruling.

This case was filed on April 7, 2015, and is set for trial on September 26, 2016. Given the fact that the case will be 18 months old by the time of trial, the Court finds there is no good cause to stay trial pending appeal as more prejudice will accrue to Plaintiff by a stay than Defendants will suffer if a stay is denied.
