Motion to be Relieved as Counsel for Valentine Capitol and John Valentine

Counsel for Plaintiffs/Cross-Defendants seek to be relieved as counsel, pending a hearing on an Order to Show Cause re Contempt against their clients. The motion is opposed by Defendants/Cross Complainants, on the narrow grounds that the pending OSC hearing is not identified in the moving papers.

The Opposition is well taken. The required declaration filed by counsel omits the OSC hearing set on June 2, 2016 at 9 a.m. in Department 6. Further, the court?s docket notes another motion filed against their judgment debtor clients, which is set for hearing on June 16, 2016.

As the Court cannot be satisfied that the clients have been properly noticed and advised of all pending hearings, the motion is DENIED at this time, without prejudice. The motion is continued to June 2, 2016 at 9 a.m. to be heard and/or further continued, pending the scheduled hearing on the Order to Show Cause. Before the motion may be granted, counsel must file an amended declaration on the required Judicial Council form that clearly advises the clients of any and all pending hearings.
