Defendants Ellen Lam and Alexander Lam?s Motion to Quash is denied. Plaintiff?s requests for judicial notice are granted.
A defendants? minimum contacts are analyzed at the time of injury, and not the time of discovery. (See, Boaz v. Boyle & Co. (1995) 40 Cal. App.4th 700.) When a nonresident commits a liability-producing act while physically present in California, the exercise of personal jurisdiction will almost always be held reasonable.? (See e.g., Lundgren v. Sup.Ct. (Kahne) (1980) 111 Cal.App.3d 477, 484.)
The parties agree that Ellen and Alexander Lam were domiciled in California until September 2011. (Alexander Lam, dec. par. 11; Ellen Lam, dec. par. 4.) Here, the Verified First Amended Complaint states that some of the acts occurred prior to September 2011, including the alleged transfer on August 31, 2011, and the Defendants alleged decision to conspire to defraud Plaintiff. (FAC ?? 28 & 73.) Thus, based on these facts, the Court finds that both Ellen and Alexander Lam had sufficient contacts with California when they are alleged to have committed some of the acts on which this case is based.
Additionally, as to Defendant Ellen Lam, the Court notes that Ms. Lam is the President and Registered Agent for Service of Process of two California Corporations, Yau Jun Global Investment and Global Real Estate Mart. (Plaintiff?s RJN, Exs 2 and 4.) In order to be the registered agent for service of process, the individual must be a California resident. (Cal. Corp. Code ? 1502(b).) The Statement of Information for Yau Jun Global Investment was filed with the Secretary of State on July 17, 2014. (Plaintiff?s RJN, Ex 2.) The Statement of Information for Global Real Estate Mart was also filed with the Secretary of State on July 17, 2014. (Plaintiff?s RJN, Ex 4.)
Therefore, the Court finds it appropriate to exercise jurisdiction over these defendants and the motion to quash is denied.
