Ruling😕 The motion of defendants Richard Blech and Secure Channels for a protective order that limits the time and scope of the second session of Richard Blech?s deposition is denied.? All requests for sanctions are denied.?

Defendants move for a protective order to limit the continued deposition of Richard Blech and for an order imposing a monetary sanction of $3060 against plaintiff and his attorney of record.? Defendants contend that the deposition should be limited in time as well as scope.? Plaintiff?s counsel has opposed the motion and asks for a monetary sanction of $2850 against defendants and their attorneys.

On September 12, 2016, the Court heard the plaintiff?s motion for an order compelling defendant Richard Blech to appear for a second deposition session.? At that time, the Court ordered counsel for the parties to ?meet and confer regarding a date for the continued deposition, with the expectation that it occur within the next 20 days.?

Although counsel have meet and conferred, the second session of the deposition has not occurred.? Plaintiff?s counsel has represented that she can complete the deposition within four to five hours.? In light of this representation, the Court will not issue a protective order, but it will expect both sides to honor this time limitation.

The Court also expects the deposition to occur within the next two weeks.
