Plaintiff Jane Doe?s motion to augment her expert witness list pursuant to CCP ?? 2034.610 and 2034.620 is GRANTED.??? Plaintiff?s proposed expert, Dr. Suzie Dupee, may testify in Plaintiff?s case-in-chief regarding the psychiatric and psychological testing and results used by Defendant?s expert, as well as a rebuttal witness to Defendant?s expert, Dr. Constance Dalenberg.
It appears that Plaintiff, through the mistake, inadvertence, surprise, and/or excusable neglect of Plaintiff?s counsel, did not designate a psychiatrist as her damages expert on her initial exchange, but that Plaintiff promptly sought to augment her expert witness list to include a damages expert after receiving Defendant?s damages expert?s report and learning of this mistake, and served the proposed expert witness information described in CCP ? 2034.260.? It also appears that Defendant will not be prejudiced by the proposed augmentation, and that Defendant has agreed to allow Plaintiff to augment her expert witness list. (See Motion, Sorensen Decl., ? 13. Exh. 6 ? ?We will further stipulate that you can call Dr. Dupee in your case-in-chief so long as the court will allow it.?)? Thus, Plaintiff?s motion to augment her expert witness list is GRANTED.
