This is an employment action arising from acts of racial harassment.??Plaintiff seeks leave to file a second amended complaint which principally adds an eighth cause of action for failure to provide rest periods in violation of Lab. Code ? 226.7 as well as additional factual allegations in support of Plaintiff?s seventh cause of action pursuant to PAGA.

There is no evidence of prejudice from the aforementioned amendment as trial in this matter is set for July 23, 2018.??Further, Defendants submit a response in which they state that they do not oppose the amendment.??Finally, the Motion substantially complies with Cal.
