On October 9, 2014, Plaintiff Jose Chavarin (?Plaintiff?) filed this action against Defendant Cities Towing and Storage, Inc. (?Defendant?) for alleged damages arising out of an October 12, 2012 vehicle collision. At the time of the filing of this action, Defendant was an active corporation. Declaration of Diane O. Palumbo, ? 5. Defendant?s corporate status is now listed as suspended under the California Secretary of State website. Id., ? 6. Liberty Insurance Underwriters, Inc. (?Liberty?) was the automobile insurer for Defendant at the time of the incident. Id., ? 7. Liberty now seeks leave to intervene and file a Complaint-In-Intervention. Plaintiff has stipulated to the intervention.

Upon timely application, any person, who has an interest in the matter in litigation, or in the success of either of the parties, or an interest against both, may intervene in the action or proceeding. Cal. Code of Civ. Proc. ? 387(a).

Liberty?s unopposed Motion is GRANTED. Liberty is ordered to file and serve its proposed Complaint-In-Intervention within ten (10) days of the date of this Order.

Parties who intend to submit on this tentative must send an email to the Court at SMCDEPT98@lacourt.org indicating intention to submit on the tentative as directed by the instructions provided on the court website at www.lacourt.org. If the department does not receive an email indicating the parties are submitting on the tentative and there are no appearances at the hearing, the motion will be placed off calendar.
